No Error In Grant of Injunction.
In Jovian S. Monette, DDS, a Professional Dental Corporation et al vs Affordable Care, LLC et al, Case No. 2026-C-0769, defendant/relator, Affordable Care, LLC, on October 21, 2026 in a 2000 page filing sought emergency writs to the Louisiana Fourth Circuit Court of Appeal seeking reversal of the Judgment by Judge Jennifer Medley of the Civil District Court overuling Affordable’s exceptions of Improper Venue and Prematurity and granting the Plaintiff’s Motion for a Preliminary Injunction which enjoined Affordable’s use of Plaintiff’s professional credentials post contract termination and additionally enjoined Affordable from proceeding with an Arbitration proceeding it commenced against Plaintiff in North Carolina until Judge Medley could determine the arbitrability of: 1) issues apparently carved out from arbitration in the arbitration clause of the mangement contract between the parties and 2) issues arising under a separate contract of lease between the parties which contained no arbitration clause. In an order issued by the court of appeal on October 22, 2026 Plaintiff was given until noon on October 23, 2026 to respond to relator’s writ application. Plaintiff timely responded through its counsel (A&G). In denying the writ on the afternoon of October 23, 2026, the three judge panel consisting of Judges Johnson, Jenkins and Atkins succincly observed:
“Finding no error, Relator’s writ application is denied.”
Hats off to A&G Shareholders, DeWayne L. Williams and William D. Aaron, Jr. who represented the Plaintiffs before the trial and appellate courts.
