In Carver Theater, LLC et al vs Kristen Melancon et al the Civil District Court for the Parish of Orleans was misled into referring the case for Arbitration before a panel of three Arbitrators. At the conclusion of the Arbitration which ended with an Award in favor of the Defendants, the Plaintiffs moved the Arbitrators to vacate their Award based on testimony given during the Arbitration by the defendant Kristen Melancon that she never intended to honor the contract at issue…
Class and Collective Actions
Our class action attorneys have represented both Plaintiffs and Defendants. On the defense side our attorneys have successfully defended businesses and governmental entities in toxic tort, product liability, traffic ticket and employment related class actions filed in state and federal courts. On the plaintiffs side our attorneys have served as lead or local counsel in class actions in a variety of substantive areas. They are currently serving as lead counsel in a major class action against the State of Louisiana and involving penalties assessed in connection with the lapse of automobile insurance. They have recently been retained to serve as local counsel in class actions against opioid manufactures and distributors. Our attorneys have represented large private as well as public sector employers in collective actions for overtime and other damages brought in federal court pursuant to the Federal Labor Standards Act (FLSA). In addition to serving as advocates, attorneys in our litigation group have served as court appointed special masters in class actions and other multi-party litigation involving naturally occurring radioactive materials, asbestos and tobacco.
