Appellate Victory Obtained For Local Bank

Aaron attorneys, Bill Aaron, DeWayne Williams and Rose Hager score appellate victory in Whitney National Bank vs McFarland.    This case involves a collection action and subsequent simulation action brought by Whitney National Bank in state district court.   In defense of the simulation action, and efforts by the bank to collect on the judgment obtained in the collection suit,  the defendants filed a reconventional demand against the bank alleging fraud and ill practice by the bank and its original attorneys with respect to the judgment obtained in the underlying collection action.   Aaron attorneys, Bill Aaron, DeWayne Williams and Rose Hager were brought in as substitute counsel for Whitney National Bank in the trial court proceedings, and obtained a judgment from the district court dismissing the defendants' reconventional demand based on prescription.    This dismissal was upheld on September 29, 2010 by a three judge panel of the Louisiana Fourth Circuit Court of Appeal.
